((Mar 19 09)) The case of the trumped-up rape charges against Smith caused a diplomatic row between the U. S. government and the P. I. government. The fuel to the fire was ultra-nationalists, those rascals being almost to a man racists! It was all meant to embarrass the bucktoothed dwarf, their Prez. That is what it was about and poor daniel smith was a political football being kicked about!
The U. S. spent millions in 2008 to send jets to clark airfield for the upcoming military exercises. The diplomatic row ensued and the U. S. cancelled those second military exercises in 2008. They sent men to pick up the jets and other equipment, but guess what? The panhandlers ((Philippine Generals on the base)) tried to steal the jets and related equipment!
After a few phone calls were made the pick-up people were allowed to get the U. S. properties!

[President Arroyo] has nothing to do with this. It was the decision of the family, she told ABS-CBN News.
She added that it was unlikely that they would consult government since "the government has never helped us."

"I'm a U.S. expat (retired) living in the Philippines and I feel compelled to bring to your attention the fate of Marine Lance Cpl. Daniel Smith who is a uniformed serviceman that the Brush administration allowed to be put on trial in a Philippine civilian court.
The U.S. government knew the rape charges to be "trumped-up". The woman in question said in open court under oath that it never happened and that it was the Philippine National Police that forced her to file the charge in the first place also the trial transcript will verify that fact!
Originally there were four other Marines accused of the same crime involving the the same woman, but were later freed in an agreement between the Philippine Government and the U.S. Government to preserve the VFA (Visiting Forces Agreement) and to appease the powerful Philippine politicians that hate America and Americans.
The Philippine News Media made a public spectacle of the trial and major international incident of the story everyday for more then a year in a attempt to incite hate amongst a people that already have a lot of prejudice against America and Americans. This had the effect of making many Americans living here very very uncomfortable and subjected all of us to a lot of bigoted actions and racially motivated remarks when we had to go into the general public.
The trial was a complete sham and court was moved from the area the alleged crime took place (Subic Bay) to Manila, for maximum media exposure, greater public reaction and a guaranteed conviction by any and all means necessary!
They even "invented"((quickly passed and made it recto-active)) a law, while the trial was in progress, to convict him because other-wise they would have had to free him for lack of evidence as no rape occurred by the victim's own admission. The invented law said that "A MAN CAN'T HAVE SEX WITH A WOMAN AFTER HE BUY'S HER AN ALCOHOLIC DRINK! So there you are. People like the bigoted American hater, Miriam Defensor Santiago - "The Pig", a elected law-maker in the Philippine Islands' government, with her virulent anti-Ameican racism led the charge to convict the innocent man. When I say "elected" it is understood that the one winning the elected position usually outspends the loser in vote buying.
The U.S. government should be ashamed in allowing this to occur. Now Cpl Smith is confined to the U.S. Embassy (in uniform) awaiting a Appeals' court decision on his conviction in a country where justice in any form for a foreigner, especially a American, is unheard of.
The prejudice directed towards people of other nationalities and the double standards here are outrageous, but it's common place and you either take it or leave the Philippines! I stay here because I have relatives here and it's cheaper then living in the U.S. and there is no other housing or living alternative to fit my limited income. But to allow a U.S. serviceman in uniform to be put on trial in a foreign country by a foreign government is unheard of and has never been done in the history of AMERICA. It's the same as putting the United States Government on trial because Cpl. Smith is U.S. Government property and I believe under our present CONSTITUTION is unlawful.
If the U.S. news media had covered this story proficiently the American people would have been outraged at the Bush Administration for permitting this insult to justice an a obvious violation of Cpl. Smith's right to a fair trial in a time where so many other American servicemen are sacrificing their life to defend our country! Marine Lance Cpl. Smith did not ask to come to the Philippines, he was sent there by our Government. Are we going to continue to turn a blind eye an deaf ear to a innocent American fighting man that needs our help and a story that needs to be told?
This kind of legal lynching is all to familiar to me and many other Americans. People of other nationalities in this country have suffered the same fate at the hands of these bigots for over forty years, yet we admit thousands of Filipinos into America each year with a guarantee that they have all the rights and privileges of America.
Our Government is well aware of these unjust conditions, sets-ups, rabbit traps, bogus charges and violations of human rights! Yet it is one of the best kept secrets in our State Department. Why does the U.S. news media refuse to touch it...........????.....I would like to know why?
As an American I know that the only way to fight this kind of Hate is to expose it to the world because everyone deserves at very least, a fair trial in any court of law in the world..............but a fair trial in the Philippines is the last thing you will receive unless you are a Filipino!!!!! New justice to handle Smith appeal, Palace to go ‘very slow’ on Smith case.
MANILA, Philippines -- Malacañang will go “very slow” on the case of convicted American rapist Daniel Smith until the Department of Foreign Affairs (DFA) and the US embassy “renegotiate” an agreement on his detention so as not to strain its ties with Washington, a Palace official said.
Interior Secretary Rolando Puno ((This is just one of many corrupt motherfu#$ers in their government)) also said negotiations for a new detention facility for US Marine Lance Corporal Daniel Smith, who has been detained in his country’s embassy, would be a “long process.”
On Wednesday, the Supreme Court ruled that Smith, who was found guilty of raping a Philipina, should be returned to Philippine custody and nullified an agreement signed by Foreign Affairs Secretary Alberto Romulo and US Ambassador Kristie Kenney for his detention at the American embassy in Manila. ((The Philipinos are good at breaking signed agreements, contracts and the like))
But the court upheld the constitutionality of the Visiting Forces Agreement (VFA), which governs the conduct of American military forces in the country, and said both countries could negotiate where Smith is to be jailed.
“If we start making statements about where the custodial places will be, we are already prejudging the process of renegotiation,” Puno told reporters in Malacañang. “We don’t want to do that because it will unduly affect the atmosphere of friendship we have with the United States and of the VFA so we have to go very slow on this and not get ahead of ourselves.”
Puno said “the status quo remains” until Romulo and Kenney come up with a new agreement.
Executive Secretary Eduardo Ermita issued a similar statement: “Pending completion of the negotiations, the status quo shall be observed in accordance with the decision the Supreme Court itself.”
On the other hand, deputy presidential spokesman Anthony Golez gave assurance that the executive branch would comply with the high court ruling.
“The important thins is we will go by the Supreme Court ruling...We will do everything we can to make sure that the Supreme Court ruling will be followed,” he told a news conference at the Palace.
“We have to understand where we are in all of this so we don’t get ahead of ourselves; renegotiating the agreement is, first, a long process, if it even begins,” Puno said.
“I don’t think we should jump the gun. Let’s not get ourselves upset or excited about this because the first step is the portion of the Supreme Court decision…asking the Department of Foreign Affairs to renegotiate this. Barring that, there can be no change in the situation,” he said.
In 2007, the annual Balikatan war games between US and Filipino forces was delayed, and later scaled down amid the custody battle for Smith.
In December 2006, a Makati City court found Smith guilty of raping a Philipina, identified in court only as Nicole, at the former Subic Naval base in November 2005.
Three other US servicemen were acquitted -- Staff Sergeant Chad Carpentier, and Lance Corporals Dominique Duplantis and Keith Silkwood.
They allegedly ((Yea mates, VERY allegedly)) cheered Smith on as he raped Nicole at the back of a rented van.
Smith was detained at the Makati City jail following his, conviction but,was soon after spirited out and transferred to the US embassy by Philippine authorities."
The only reason poor Daniel Smith was ever tried was to embarrass the horny-toad, GMA, the Prez! It was pushed by the opposition groups to harm the treaty between the U.S. and the P.I. on American military personnel.

We humbly suggest that the State Department place conditions on giving materials to The P.I. by requiring that Daniel Smith be allowed to freely leave and all other Americans and other peoples residing or jailed under trumped-up charges! How about it Ambassador?
Asked if any local politician could be considered as an Obama of the Philippines, Ermita said,
"It is expected that others would try to follow the strategy of Obama, especially with elections in the Philippines only 18 months away."
We have a question for the Philipino leaders. Your people came to those islands and stold them from the black Aeta people, whom you have forced into the deep jungles to grovel to live. You conducted medical experiments on them also.
The question we want to ask is this,
When will you racists elect one of them, a black, to be your President?

They are so embarrassed that the news media did not cover it! Not one media person or station commented on the news of his acquittal after three years of making a international ordeal of the case!!! But you can bet your bottom dollar that any American who has any kind of court case in the Philippines will pay the price and every American the police see on the streets will be guilty of some kind of crime, just for being in the (Philippines) country and immigration is going to go crazy on Americans with expired visas even if they are only a few days late."

But when the court said he was to be immediately released the embassy had him on a plane within 30 hours. Now the racists are crying foul! Here for your consideration are the facts of their continued normal P. I. racism!
Militant groups held a rally at the Court of Appeals (CA) and the United States embassy in Manila assailing the acquittal of Smith in the Subic rape case.
Members of Task Force Subic Rape and Bagong Alyansang Makabayan (BAYAN) trooped to the CA and criticized the decision.
According to Renato Reyes of Bayan, the Visiting Forces Agreement (VFA) should be abrogated since the acquittal may be used for future criminal immunity of American servicemen.
He said, "pwedeng maging leverage para may immunity, para hindi mapanagot ang mga Amerkanong sundalo sa ating batas."
Womens' group Gabriela, which is under Bayan, said the decision is an insult to Filipinas especially with the use of the phrase "romantic episode" to describe what happened between Daniel Smith and Nicole, who earlier cried rape but later on recanted her statement.
Gabriela spokesperson Joms Salvador said, "yung paggamit ng romance, parang hindi nila kinikilala ang katotohanan ng rape."
The group Task Force Subic Rape likewise denounced the CA decision and called for the scrapping of the VFA.
"Nakakahiya, hindi man lang binigyang timbang ang testimonya noon ni nicole...alam natin na may panggagagahasa," said Lotlot Requizo, spokesperson of Task Force Subic Rape."
And that is the normal racism any visitor does not want to see, but as you live among them for a few years you see how they are!
